Terms of Use
Effective September 12, 2026. These Terms govern your purchase and use of BenchBuddy, provided by Carolina Pinball Repair (“BenchBuddy,” “we,” “us,” or “our”). By purchasing, activating, or using BenchBuddy, you agree to these Terms. If you do not agree, do not purchase or use the software.
Business software and permitted use
BenchBuddy is local-first repair-shop workflow and recordkeeping software. Subject to payment and these Terms, we grant you a limited, nonexclusive, nontransferable, revocable license to use BenchBuddy for your own lawful business operations on the number of computers allowed by your subscription. You may not resell, sublicense, share license keys, bypass licensing controls, reverse engineer except where applicable law expressly permits it, use the software unlawfully, or interfere with the service or its security.
Your records, decisions, and backups
You control the customer, repair, inventory, payment, mileage, route, expense, manual, and other records you enter. You are responsible for having authority to process that information, protecting access to your computer and backups, maintaining independent current backups, verifying all calculations and outputs, and complying with laws and business obligations that apply to you. BenchBuddy is not a system of record for banks, tax authorities, courts, insurers, or regulators.
You are solely responsible for the files, manuals, images, records, and other content you import, store, link, or use with BenchBuddy (“User Content”). You represent and warrant that you own or have all permissions, licenses, and other rights necessary to use your User Content and that your User Content and use of BenchBuddy do not violate any law or any third party’s intellectual-property, privacy, publicity, confidentiality, or other rights.
Financial, tax, inventory, mileage, route, invoice, and report outputs are informational aids and may contain errors or depend on inaccurate or incomplete inputs. They are not legal, accounting, tax, financial, safety, or other professional advice. Review important outputs with a qualified professional.
Indemnification
To the maximum extent permitted by law, you will indemnify, defend, and hold harmless Carolina Pinball Repair and its owners, personnel, and service providers from and against third-party claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use or misuse of BenchBuddy, your violation of these Terms or applicable law, or your violation of a third party’s rights.
Subscriptions, activation, and changes
A BenchBuddy Pro subscription provides access while active, subject to license activation and reasonable anti-abuse controls. Subscriptions may renew according to the terms shown at checkout until canceled through the available billing or support process. We may release corrections, security updates, compatibility changes, or feature changes. We may suspend or terminate access for nonpayment, misuse, fraud, security risk, or material violation of these Terms.
Taxes and third-party services
Listed prices exclude sales, use, or similar transaction taxes unless stated otherwise. Applicable tax may be calculated at checkout; where tax is not collected, you may remain responsible for it. Stripe processes payments, Keygen supports license activation, and hosting, operating-system, email, or other providers may support related functions. Their services and terms are separate, and we are not responsible for third-party outages, changes, or acts outside our reasonable control.
No warranties
To the maximum extent permitted by law, BenchBuddy and all related services, content, updates, and outputs are provided “as is” and “as available,” with all faults and without warranties of any kind, express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, security, and uninterrupted or error-free operation. We do not promise that the software will meet every requirement or prevent data loss.
Limitation of liability
To the maximum extent permitted by law, Carolina Pinball Repair and its owners, personnel, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, business, goodwill, or opportunities; or loss, corruption, disclosure, or recovery of data, arising from or related to BenchBuddy, even if advised that such damages were possible.
To the maximum extent permitted by law, our total aggregate liability arising from or related to BenchBuddy will not exceed the amount you paid for BenchBuddy during the twelve months immediately preceding the event giving rise to the claim. These exclusions and limits apply regardless of the legal theory, but do not exclude liability that applicable law does not allow to be excluded or limited.
Governing law and general terms
These Terms are governed by North Carolina law, without regard to conflict-of-law rules. To the extent a dispute may be brought in court, the parties consent to the state or federal courts with jurisdiction in or over Davie County, North Carolina. Before filing a claim, please contact us and allow a reasonable opportunity to resolve the issue informally.
If any provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue in effect. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy and Refund Policies and checkout terms, are the agreement concerning BenchBuddy. We may update them prospectively by posting a revised effective date; material changes apply as permitted by law.
